Risk Management Rounds
Emergency Medicine

Overview

A recent study revealed that an estimated 107.5 million visits were made to hospital emergency departments, about 38.4 visits per 100 persons.  Many of those were patients who had never been to the ED before; however, about 3 percent had previously been seen in the same ED within the previous 72 hours.  Both situations present risk: the new patient because there is no existing positive doctor-patient relationship to buffer the ED experience, and the returning patient because the original presenting complaint is not resolved.  Emergency medicine specialists, like other physicians, must be aware of the risks and tactics they can use to reduce them.

Objectives

Upon completion of this course, a physician should be able to:

1. Analyze a case scenario to determine whether it meets the criteria for malpractice.
2. Discuss four communication factors that often contribute to malpractice cases.
3. Identify five sources of error in emergency medicine.
4. Analyze four case scenarios to determine whether an EMTALA violation took place.
